These Terms and Conditions (“Agreement”) govern your use of this website and any reservation or stay at properties managed by Emily Meyer (“Host,” “we,” “us,” or “our”), located in Sioux Falls, South Dakota. By contacting us, making a reservation, or occupying the property, you (“Guest”) agree to be bound by this Agreement in full.
1. Acceptance of Terms
By accessing this website or making a reservation, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree, you must not proceed with a booking or occupy the property.
2. Reservations & Booking Confirmation
A reservation is not confirmed until the Host provides written or verbal confirmation and any required deposit has been received. The Host reserves the right to decline any booking at our sole discretion without providing a reason.
3. Check-In & Check-Out
- Check-in: 4:00 PM (or by prior written arrangement)
- Check-out: 11:00 AM (or by prior written arrangement)
Failure to vacate by the agreed check-out time may result in additional charges equal to one additional night’s rate.
4. Occupancy & Use
- The property may only be used for private residential purposes — no commercial use, events, or parties without prior written consent from the Host.
- Maximum occupancy must not be exceeded at any time.
- Guests are responsible for the conduct of all members of their party and any visitors they invite onto the property.
- Any activity that causes a disturbance to neighbors, violates local ordinances, or creates a nuisance is strictly prohibited.
- Quiet hours: 10:00 PM to 8:00 AM.
5. Guest Responsibilities & Damage
Guests agree to:
- Leave the property in the same condition in which it was found.
- Report any damage, breakage, or maintenance issue to the Host immediately.
- Not remove, damage, or destroy any furnishings, fixtures, or equipment.
The Guest is fully liable for any damage, loss, or additional cleaning costs caused by themselves, their party, or their visitors. The Host reserves the right to charge the Guest’s provided payment method for any such costs. This includes but is not limited to damage to furniture, fixtures, appliances, walls, flooring, and landscaping.
6. Pets
Pets are permitted only with the Host’s prior written approval. Undisclosed or unauthorized pets may result in immediate termination of the stay without refund, plus an additional cleaning fee. Guests are liable for any damage or injury caused by their pets.
7. Smoking & Illegal Activity
- Smoking, vaping, and use of illegal substances are strictly prohibited inside the property at all times.
- Violation may result in immediate termination of the stay without refund and the Guest will be liable for all remediation costs (including professional cleaning and deodorization).
- Illegal activity of any kind on the premises is grounds for immediate eviction and may be reported to law enforcement.
8. Right of Entry
The Host or authorized agents reserve the right to enter the property at any time in case of emergency, or with reasonable notice for inspections, maintenance, or repairs.
9. Cancellations & Refunds
Cancellation and refund terms are agreed upon at the time of booking and confirmed in writing. Unless otherwise agreed in writing:
- Cancellations made more than 14 days before check-in are eligible for a full refund minus any processing fees.
- Cancellations made within 14 days of check-in are non-refundable.
- No-shows are non-refundable.
The Host is not responsible for any travel expenses, flights, or other costs incurred by the Guest in connection with a reservation.
10. Limitation of Liability
To the fullest extent permitted by applicable law, the Host shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:
- The Guest’s use or inability to use the property
- Any personal injury, illness, or death occurring on or near the property
- Loss or theft of personal belongings
- Interruption of services (internet, utilities, appliances)
- Acts of third parties, including neighboring properties or service providers
- Weather events, natural disasters, or other circumstances beyond our control
The Host’s total liability to the Guest under any circumstances shall not exceed the total amount paid by the Guest for the specific stay giving rise to the claim.
11. Indemnification
Guest agrees to indemnify, defend, and hold harmless Emily Meyer, her agents, representatives, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Guest’s breach of this Agreement
- Guest’s negligence or willful misconduct
- Any injury to persons or damage to property caused by the Guest or their party
- Any third-party claims arising from Guest’s use of the property
12. Assumption of Risk
Guest acknowledges that certain amenities (including but not limited to the sauna, fire pit, pool table, and outdoor areas) carry inherent risks. By using these amenities, Guest voluntarily assumes all risks of injury or damage. The Host makes no warranties about the fitness or safety of any amenity for a particular purpose.
13. Force Majeure
The Host is not liable for failure to fulfill obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, utility failures, or other events of force majeure. In such cases, the Host will make reasonable efforts to offer alternative dates or a partial refund at our discretion.
14. Website Disclaimer
This website is provided for informational purposes only. All content — including photographs, descriptions, and property details — is owned by Emily Meyer and may not be reproduced without written permission. We make no guarantees that website content is error-free or continuously available.
15. Privacy
Your use of this website is also governed by our Privacy Policy .
16. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Sioux Falls, South Dakota, under the rules of the American Arbitration Association. The prevailing party may be entitled to recover reasonable legal fees at the arbitrator’s discretion.
17. Governing Law
This Agreement is governed by the laws of the State of South Dakota, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Minnehaha County, South Dakota.
18. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
This Agreement, together with any written booking confirmation, constitutes the entire agreement between the Host and Guest and supersedes all prior discussions or representations.
